This book develops an alternative account of rights according to which rights forfeiture has a much smaller role to play because rights themselves are more contextually contingent. For example, those who threaten to cause harm without a right to do so have weaker claims not to be killed than innocent bystanders or those who have a right to threaten to cause harm. By framing rights as the output of a balance of competing claims, and by laying out a detailed account (...) of how to balance competing claims, Walen provides a more coherent account of when killing in war is permissible. I argue that nonresident aliens, in places that are clearly not U.S. territory, should benefit from constitutional rights. This is a matter of mutuality of obligation. The U.S. claims the authority to hold all people accountable for respecting certain laws, such as the law of war as defined in the Military Commissions Act. Accordingly, it must accord them basic legal rights in return. At the same time, I argue, contra Benjamin Wittes, that this would not lead to absurdly opening the (...) courthouse doors, nor does it require abandoning principle to keep the flood of litigation reasonably contained. Not all harms inflicted by the U.S. government can give rise to a lawsuit, and that the distinction between those who should have a right to sue and those who should not can be drawn in a principled way. In her latest writing on the trolley problem, 'Turning the Trolley,' Judith Jarvis Thomson defends the following counter-intuitive position: if confronted with a choice of allowing a trolley to hit and kill five innocent people on the track straight ahead, or turning it onto one innocent person on a side-track, a bystander must allow it to hit the five straight ahead. In contrast, Thomson claims, the driver of the trolley has a duty to turn it from the five onto the (...) one. Thomson’s argument is fundamentally flawed in several important ways. We explain her argument and identify its major flaws. Our aims are: (a) to show that Thomson has not provided reason to think such an act is not permissible, and (b) to use the process of exposing the weaknesses in different parts of her argument to demonstrate the importance of undertaking what we call a Hohfeldian analysis of the 'mechanics' of the rights in play. A Hohfeldian 'mechanics' of rights extends the distinctions that Hohfeld first introduced to take into account the pro tanto normative 'forces' at work on an agent, the balance of which determines who in the end has what kind of right. A robust, if not absolute, prohibition on treating people simply as a means sits at the core of common sense deontological morality. But the principle prohibiting such treatment, the "means principle" (MP), has been notoriously hard to defend. This paper has two parts. In Part I, I survey why the interpretation of the MP in terms of intentions does not work, and why the interpretation in terms of causes, as defended up to now, is so mysterious as to be question (...) begging. I also explore Judith Jarvis Thomson's early and admittedly failed attempt to explain the MP in terms of rights. In Part II, I articulate and defend a new account of a causal interpretation of the MP. The principle I defend there, the Restricting Claims Principle, registers the moral significance of the fact that certain claims have a kind of moral externality: if they had to be respected as rights that would restrict what agents could do on behalf of other patients. Claims that impose that sort of externality, restricting claims, register as less weighty than claims that do not. The claims of those who would be used simply as a means (a causal notion) are not restricting, and that explains why they are stronger than competing restricting claims. (shrink)

A general framework by which dynamic interactions within a protein will promote the necessary series of structural changes, or “conformational cycle,” required for function is proposed. It is suggested that the free‐energy landscape of a protein is biased toward this conformational cycle. Fluctuations into higher energy, although thermally accessible, conformations drive the conformational cycle forward. The amino acid interaction network is defined as those intraprotein interactions that contribute most to the free‐energy landscape. Some network connections are consistent in every structural (...) state, while others periodically change their interaction strength according to the conformational cycle. It is reviewed here that structural transitions change these periodic network connections, which then predisposes the protein toward the next set of network changes, and hence the next structural change. These concepts are illustrated by recent work on tryptophan synthase. Disruption of these dynamic connections may lead to aberrant protein function and disease states. (shrink)

This paper reviews Alec D. Walen’s _The Mechanics of Claims and Permissible Killing in War_.

This article is a response to an essay written by an academic in English Literature, Professor John Sutherland. Through close textual analysis,Sutherland purports to resolve a well-known literary question: whether the sexual encounter outlined in the Victorian novel Tess of the d'Urbervilles should be classified as rape or seduction. The present article rejects his conclusion on the matter. An(equally) close analysis of the fictional text in question and of Sutherland's gloss, demonstrates the partiality of his critique, both in literary-critical and (...) critical-legal terms. In addition, examination of the conceptual and historico-legal context regarding the notions of rape and seduction on both sides of the Atlantic highlights parallels between Sutherland's own partiality and that of the law. In short, the apparent objectivity of the textual analysis and subsequent critique undertaken by Sutherland is revealed as a continuation of legal and patriarchal prejudices defining rape and seduction. The use of close textual analysis as the key critical device promotes the apparent probity of his findings. Locating them in an essay collection designed for mass lay public consumption completes the circle – from partisan scholarship to `informed' popular prejudice. (shrink)

We are likely to have immersive virtual reality and ubiquitous augmented reality in the coming decades. At least some people will use extended reality or “the metaverse” to work, play and shop. In order to achieve the best possible versions of this virtual future, however, we will need to learn from three decades of regulating the Internet. The new virtual world cannot consist of walled corporate fiefdoms ruled only by profitmaximization. The interests of workers, consumers and citizens in virtuality require (...) proactive legislation and oversight. -/- This white paper first addresses the central question the metaverse poses, whether virtual life is inherently more alienating and less authentic than face-to-face life experiences. The fraught ideological relationship between liberalism and imperialism has been theorized primarily through the British, French, and American empires. This article moves beyond the experiences of these “great powers” by turning to Spain and its preeminent twentieth-century liberal thinker, José Ortega y Gasset. Unlike his British, French, and American counterparts, Ortega articulated liberalism not to promote or defend the forging of empire but rather to cope with the disorienting effects of its unequivocal loss in the wake of the Spanish–American War. (...) The experience of imperial loss, I argue, informed Ortega’s call for a “new liberalism” that could enable Spain’s national and cultural renewal. Reading Ortega’s thought in this context thus reveals the lasting impact that imperial dispossession can have upon certain strands of liberalism. It also suggests that, in order to fully capture the relationship between liberalism and empire, it is necessary to incorporate a wider range of historical sources and imperial trajectories. The moral justification for targeted killing turns on it being justified as an act of self-defense. That justification can be assessed by addressing five questions: Is the targeted person a threat who lacks the right to threaten? Has the targeted person forfeited some of her claim not to be killed? Even if the answer to the first two questions is positive, is targeted killing a necessary and proportionate response? Is the evidence in favor of targeted killing high enough to meet (...) the relevant standard of proof? And insofar as a person is selected for targeting from a larger group of possible targets, is the selection justifiable? The legal justifiability of targeted killing should aim to track, as much as problems of administrability and limiting unwanted effects allow, the answers to those moral questions. (shrink)

What Is Race? Evidence from Scientists is a picture book for schoolchildren published by UNESCO as part of its high-profile campaign on race. The 87-page, oblong, soft-cover booklet contains bold, semi-abstract, pared-down images accompanied by text, devised to make scientific concepts ‘more easily intelligible to the layman’. Produced by UNESCO’s Department of Mass Communication, the picture book represents the organization’s early-postwar confidence in the power of scientific knowledge as a social remedy and diplomatic tool. In keeping with a significant component (...) of the race campaign, What Is Race? presented genetics as the route to an enlightened, scientific, non-prejudiced understanding of race. This article seeks to explain the book’s management, aesthetics and framing in the context of postwar disciplinary and international politics. Viewing UNESCO’s race campaign as a high point for an internationalist ideology of mass education, this article also analyses the visual and literary arguments of What Is Race? and proposes that the enduring image of genetics as technical and neutral knowledge was in part shaped by UNESCO’s efforts to communicate scientific authority to an apparently ‘popular’ audience. Collections of living organisms are reservoirs of biological knowledge that operate across times and places. From the mid-20th century, scientific institutions dedicated to the cultivation of such collections have routinized and professionalized their care. But “care,” for these collections, is focused not just on individual organisms—instead, a principal aim of a curator is to maintain the integrity of a reproducing “strain,” “variety,” “line,” or “stock,” and the composition of a collection as a whole. This paper explores the forms, the material (...) dimensions, the temporalities, and the values of that care, to recover the conditions under which scientist-custodians maintain continuity of research over many decades. This paper does so by focusing on two rather different kinds of scientific collection: that of Drosophila fruit flies on the one hand, and plant seeds on the other. Their comparison is valuable because their vastly different needs and life cycles engender very different practices of care. Comparing the materialities, life cycles, needs, and values of these divergent collections helps to draw attention to the routine and the apparently mundane. First, the paper asks: what kinds of work go into managing such collections—that is, the day-to-day management and cultivation, surveillance, and administration of information? Second, it asks: how do these practices maintain the integrity of the strains and stocks, and the collections themselves? What kinds of value does this work create? Third, what are the future imaginaries that are rhetorically drawn into the funding strategies of these collections, and how do they envision future use, ownership, and control? (shrink)

In his analysis of the concept of causality, Hume finds that all events accounted causes and effects are contiguous and successive. No object can act efficaciously upon another so long as the objects are at a distance from each other. It may sometimes appear that “distant objects are productive of one another,” but on examination it is discovered that they are linked together by a series of intermediate causes which are contiguous among themselves; and even where examination does not directly (...) disclose the intermediate causal chain, it is still presumed that it exists. Also the cause is temporally prior to the effect. If I throw a stone through a window, the smashing of the glass follows the act of throwing the stone. It is only after the realization of the cause that the effect appears. Thus a cause is an object that is precedent to and contiguous with another object that is called the effect. (shrink)

It may be argued that Joyce's work can be seen either as the defining text of a real and historically grounded nationhood or, conversely, as the defining text of an imaginary and ahistorical nationhood. It may in other words be viewed as either epical or Utopian—and as addressing a modernist predilection for either of those forms. This paper examines the relations between, on the one hand, accounts of the distinction between an agent's identifying with, as opposed to feeling alienated from, their attitudes; and on the other, metaphysical accounts of action. It claims that a commitment to an event-causal conception of agency, which would analyse agency in terms of the causal potency of psychological states and events, appears to render mandatory a particular style of account of identification and alienation – namely, the hierarchical model offered by (...) Harry Frankfurt and Michael Bratman. It is argued that such accounts fall foul of a dilemma: the Authority Problem. The failure of attempts to avoid the Authority Problem is then used to motivate an attractive alternative style of account of the distinction, offered by Richard Moran. However, it is pressed that Moran's account rests on claims about agency which seem incompatible with the event-causal conception of agency. By making the links between the metaphysics of agency and accounts of identification and alienation more explicit, the paper allows us to better comprehend both the apparent need for and characteristic failures of some traditional accounts of identification and alienation, as well as make clear the action-theoretical debt incurred by those who would offer an alternative. When one is intentionally doing something, one represents that thing as a goal to be accomplished. One represents it practically. How should we characterize this practical representation further? In this paper, I argue that when one is intentionally doing something, one's representation of it as a goal to be accomplished must also be knowledge that one is intentionally doing that thing. And I argue that this knowledge must itself be one's intentionally doing that thing.
